Active Class Actions

Northwood Halifax COVID-19 Deaths

Wagners filed a proposed class action lawsuit in the Supreme Court of Nova Scotia, on June 1, 2020. The proposed class proceeding was filed on behalf of the Plaintiff against Northwoodcare Group Inc. and related entities. The lawsuit seeks damages on behalf of the Plaintiff and other individuals who are entitled to bring an action under the Fatal Injuries Act.

RCMP Operational Stress Injuries

Wagners has filed a proposed class proceeding against the Attorney General of Canada in the Federal Court of Canada. The proposed class proceeding was filed on behalf of three Plaintiffs and seeks damages on behalf of themselves and a class of persons who are or have been enrolled as Regular Members in the Royal Canadian Mounted Police (RCMP) and who, between January 1, 1992 and August 6, 2021, have been diagnosed with, or suffered from, an Operational Stress Injury. This particular injury refers to any persistent psychological difficulty that results from operational duties with the RCMP, including but not limited to diagnosed conditions such as Post-Traumatic Stress Disorder, depression, anxiety, and panic attacks.

St. Martha’s Regional Hospital Privacy Breach

Wagners has filed a proposed class proceeding arising from a mass privacy breach of health information at St. Martha’s Regional Hospital in Antigonish, NS.

Total Loss Claims

Gluckstein Lawyers and Wagners Law Firm have jointly issued a proposed class action lawsuit against a number of automobile insurance companies for systematically underpaying consumers with total loss accident claims. Our lawsuit alleges that these insurers relied on one of two companies—Mitchell International, Inc. and Audatex (also known as Solera)—to provide valuation reports for the Actual Cash Values (“ACVs”) of total loss accident vehicles. These reports included arbitrary and illegal charges that diminished the valuations of total loss vehicles, lowering insurers’ payouts to consumers with total loss accident claims. In the Mitchell reports, these charges were called “Projected Sold Adjustments,” while in the Audatex reports they were called “Typical Negotiation Adjustments.”

Dell Data Theft

On October 1, 2020, Wagners filed a proposed class proceeding against Dell Technologies Inc. and Dell Technologies Canada Inc. The proposed class proceeding is on behalf of customers who had their personal and private customer information breached in June and November 2017.

Yarmouth Airport PFAS Contamination

A proposed class proceeding has been filed on behalf of property owners in an area next to the Yarmouth Airport who have learned their properties are contaminated by PFAS. Transport Canada, the former owner of the Airport, used PFAS-containing fire fighting foam at the fire-fighting training area at the Airport before it was sold in 1997. In 2024, property owners began to be notified about the PFAS contamination. It is alleged that there has been a loss of value of the properties as a result of the contamination.

AC624 Crash Halifax Airport

Wagners and Camp Fiorante Matthews Mogerman, a law firm in Vancouver, British Columbia, and MacGillivray Injury and Insurance Law, a law firm in Halifax, Nova Scotia, are carrying a class action against Air Canada, NAV Canada, Transport Canada, the Halifax International Airport Authority and Airbus following the crash of Air Canada Flight 624 on March 29, 2015 on its landing approach at the Halifax Stanfield International Airport.

Canadian Armed Forces / Forces Armées Canadiennes

Wagners has collaborated with four law firms to advance class actions against the Attorney General of Canada alleging sexual misconduct in the Canadian Armed Forces and Department of National Defence and Staff of the Non-Public Funds, Canadian Forces.

Deer Lake Canal Seepage

Wagners and Bob Buckingham Law of St. John’s, NL commenced a proposed class action on behalf of individuals who own property damaged by excessive water seepage from the Humber River Canal.

GM Ignition Switch

Wagners commenced a proposed class action on behalf of individuals who owned a General Motors manufactured vehicle with a defective ignition switch following several safety recalls.

Hip Products – Biomet

Wagners filed a proposed class action on behalf of Canadians implanted with a Biomet Metal on Metal Hip Implant System between 1998 to the date of certification.

Hip Products – DePuy

Wagners has filed a proposed class proceeding on behalf of individuals were implanted with a DePuy Hip Implant between July 2003 to the date of certification.

Mirena IUD

Wagners filed a proposed class proceeding on behalf of residents of Canada who claim to have suffered personal injuries allegedly as a result of the Mirena Intrauterine System, a birth control device manufactured by Bayer.

Mud Lake, NL Flooding Class Action

Wagners has filed a class action on behalf of residents affected by flooding of the Churchill River and Mud Lake in May 2017.

Deaf Schools Class Action

On January 31, 2015 Wagners filed a class proceeding on behalf of individuals who attended and/or resided at the School for the Deaf in Halifax and/or the Interprovincial School for the Education of the Deaf in Amherst.

OxyContin & OxyNEO

Wagners commenced national class action litigation against the makers of OxyContin® and OxyNEO® in 2007 seeking compensation for addiction caused by these opioids.

Roundup® Weed Killer Class Action

On July 4, 2019 Wagners filed a proposed class action on behalf of people diagnosed with Non-Hodgkins Lymphoma (“NHL”) after use or exposure to the widely-used weedkiller Roundup® between 1976 and the date of certification.
